اجرای ساز و کار مسئولیت حمایت در افغانستان پس از روی کار آمدن مجدد طالبان

چکیده

نقض‌ مکرر حقوق بشر، کوچ اجباری، ناامنی و دیگر ضعف‌ها در حاکمیت قانون و وجود فساد اقتصادی شرایط نامساعدی را در کشور افغانستان به وجود آورده است.با توجه به شرایط موجود در افغانستان و تجربیات پیشین آن، می‌توان گفت در راستای حمایت و حفاظت از حقوق ملت افغانستان، ایجاد بستری مناسب برای اعمال حق تعیین سرنوشت آن‌ها می‌تواند راهکاری برای خاتمه یافتن نابسامانی موجود در این کشور درنتیجه اشغال نظامی آمریکا درگذشته و استیلای طالبان در زمان حاضر باشد. پژوهش حاضر با روش توصیفی – تحلیلی در پی آن است که با توجه به این وضعیت اخیر در کشور افغانستان و تسلط دوباره طالبان، اعمال دکترین مسئولیت حمایت را به عنوان یک راه حل برای خاتمه به وضعیت نامطلوب این کشور امکان‌سنجی نماید. یافته‌های پژوهش نشان می‌دهد حاکمیت نه تنها حق بلکه مسئولیتی است که به موجب آن یک دولت به مراقبت و رعایت حقوق افراد تحت صلاحیت خود متعهد می‌باشد به این ترتیب در رابطه دیالکتیکی میان حاکمیت از یک طرف و ارزش‌های بشری از طرف دیگر آنتی تز مسئولیت حمایت قابل ارائه است.در این راستا اولین اقدام خروج از حالت انفعال و یا شاید بی‌تفاوتی از سوی جامعه بین‌المللی است و همچنین سعی و اهتمام بر اجرای تعهداتشان بر مبنای حقوق بین‌الملل ازجمله تعهد به شناسایی حق تعیین سرنوشت ملت افغانستان در راستای برقراری صلح پایدار و تعهد به تلاش برای خاتمه دادن به وضعیت‌هایی که نتیجه نقض جدی قواعد آمره حقوق بین‌الملل عام می‌باشند.
