The Role of Constitutional Courts in Protecting Freedom of Expression in Egypt and France; An Analysis of Two Secular and Religious Legal Systems

Abstract

The purpose of this study is to conduct a comparative analysis of the role of constitutional courts in safeguarding freedom of expression within two distinct legal systems: a secular framework, represented by France, and a religious–jurisprudential framework, represented by Egypt. The main research question is: To what extent, and through what mechanisms, have the constitutional courts of Egypt and France effectively contributed to the protection of freedom of expression based on their domestic and international human rights obligations? It is hypothesized that the French Constitutional Council, relying on the principles of laïcité and the rule of law, has provided more effective protection of freedom of expression, whereas the Egyptian Constitutional Court, influenced by religious, political, and security considerations, has adopted a more restrictive approach in this regard. The findings derived through a descriptive–analytical and comparative methodology involving the analysis of legal instruments, judicial rulings, and international human rights sources, within the theoretical frameworks of cultural relativism in human rights and the role of constitutional courts in guaranteeing fundamental rights indicate that the French Constitutional Council, grounded in the principles of republicanism and laïcité, has adopted a broader interpretation of freedom of expression and issued numerous decisions in support of media and civil activists. In contrast, although the Egyptian Constitutional Court has occasionally referred to human rights principles, in practice it remains largely influenced by governmental policies and religious considerations. Furthermore, limited judicial independence and weak enforcement of rulings are identified as key factors undermining judicial protection in Egypt.
